Roderick
P. Bushnell specializes in labor and employment cases, particularly wrongful
termination; sexual harassment; sex, age, race, national origin, and disability
discrimination and harassment cases; contract cases; wage and hour cases; and
privacy cases arising in the workplace setting. He has extensive courtroom
experience trying both civil and criminal cases, arguing pre-trial motions,
mediating cases, and defending and taking depositions.
Mr. Bushnell
has helped countless employees successfully resolve their claims against
companies ranging from small domestic companies to international corporations
known worldwide. He has procured generous settlements on behalf of his
clients, including with upper level management employees, against internet,
pharmaceutical, media, high-tech, and advertising companies, to name a few.
Mr. Bushnell’s
practice includes employment consulting in which he advises both employers and
employees regarding the staff, situation, and/or structure of their current
work environment. He advises employees on how to respond to probation and
performance improvement plans, and assists employees trying to make a change in
their work environment for professional or personal reasons. Mr. Bushnell
routinely reviews employment contracts and severance packages and assists
employees in drafting letters and communications to corporate management. He
also specializes in representing plaintiffs within the radio, television, and
advertising industry. These plaintiffs include media buyers, sales
personnel, station management, and on-the-air performers.
Roderick
P. Bushnell’s History
Mr. Bushnell
attended Rutgers, the State University of New Jersey, and earned a Bachelor of
Arts in 1966. His education concluded in 1969 at Georgetown University, where
he graduated with a Doctor of Jurisprudence. Upon graduation, he worked for the
Department of Water Resources in California until 1971, at which time he formed
his own law practice. He was admitted to practice by the State Bar of
California, the U.S. District Court for the Northern and Eastern District of
California, the U.S. Court of Appeals for the Ninth Circuit, the Supreme Court
of the United States, and the U.S. Court of Appeals for the Federal Circuit. He
is board certified in Civil Trial Law and Civil Pretrial Practice Law by the
National Board of Trial Attorneys. He also has experience in providing
mediation services, and employer consulting and litigation defense.
Mr. Bushnell
has held the position of lecturer for labor and employment seminars at the
Practicing Law Institute, the San Francisco Bar Association, and the California
Employment Lawyers Association. He served on the Board of Directors for
California Lawyers for the Arts from 1978 to 1998, serving as secretary from
1985 to 1987. He served on the Board of Directors of Bread & Roses, Inc. of
Mill Valley, California, from 1979 to 1988, serving as Chairman of the Board
from 1981 to 1984. He has also authored many articles for esteemed publications
in his industry.
Mr. Bushnell
is a member of the Consumer Attorneys of California, the San Francisco Trial
Lawyers Association, the San Francisco Bar Association, the National Employment
Lawyers Association, and the California Employment Lawyers Association. He has
been associated with the San Francisco Superior Court as an arbitrator of civil
matters and the United States District Court for the Northern District of
California as an early neutral evaluator. He has been active with the Labor
& Employment Section for the American Association of Justice, the Labor
& Employment and International Law Sections of the American Bar
Association, and is currently active with the Labor & Employment and
Litigation Sections of the State Bar of California. He is a member of the
American Society of International Law, Human Rights Subcommittee. He has
maintained involvement with the Bar Association of San Francisco as an
arbitrator for the Fee Dispute Committee and panelist for the Early Settlement
Program in the Labor and Employment Law Section.
Mr. Bushnell
has accrued several accolades and honors throughout his career, including being
recognized as a Northern California Super Lawyer in Law and Politics by San
Francisco Magazine from 2006 to the present, and has been selected for
inclusion in many editions of Who's Who in America, Who's Who in American Law,
Who's Who in the West, and Who's Who in the World. In 2018, he received the Albert
Nelson Marquis Lifetime Achievement Award by Marquis Who's Who, and for the
2019-2020 year, he was one of only twelve professionals chosen from amongst 1.5
million to represent Marquis in the Wall Street Journal.

Mr. Bushnell presently lives in San
Francisco, California with his wife of 55 years, Sue Bushnell. His son Arlo and
daughter-in-law Gail, who also live in San Francisco, have two children, Stellan and Shane.

History of the
Firm:
The
Law Office of Roderick P. Bushnell, formerly Bushnell & Caplan, LLP,
Bushnell, Caplan & Fielding LLP, Bushnell, Caplan, Fielding & Maier,
LLP, Bushnell, Caplan, Fielding & Rudy, LLP, and Roderick P. Bushnell,
Attorney at Law, has been practicing law in San Francisco since 1971. In
December 2011, David Fielding left the firm and retired in 2014. In June 2016,
Alan Caplan left the firm, also to retire. Mr. Bushnell is continuing his
solo practice in San Francisco, primarily focusing on representing plaintiffs
in cases involving Labor and Employment Law, with an emphasis on wrongful
discharge, civil rights and sexual harassment.
During
the course of the law office’s long history, it has engaged in extensive civil
and criminal litigation, both at the trial and appellate levels. The firm has
tried in excess of 100 cases, mostly in the Bay Area, and has been the law firm
of record in over 75 published appellate opinions. A number of these cases have received acclaim via the media, including
watershed sexual harassment, discrimination, and employment contract cases
against private corporations, and public entities such as the City and County
of San Francisco. The
Martindale-Hubbell Law Directory has been rating lawyers with respect to legal
ability and general ethical standards for over 100 years and the firm has
earned the highest rating awarded for legal ability and general ethical
standards.
The
firm has been lead counsel or co-lead counsel in litigation involving
shareholder derivative actions; consumer class actions; unfair competition and
false advertising cases; employment rights class actions; labor and employment
cases; and environmental lawsuits brought on behalf of the general public.
These cases are in addition to representing innumerable civil plaintiffs and
criminal defendants. Throughout the years, the firm has
won numerous single and multi-plaintiff sex discrimination and sexual harassment
cases against public entities, including all levels of federal, state, and
